Terms and Conditions

 

These Terms and Conditions govern the use of the Rydeo platform and all related services. By accessing, listing, or renting a vehicle through Rydeo, you agree to these Terms.

1. Definitions

  • Owner”: A private individual or entity listing a vehicle for rental via the Rydeo platform.

  • Renter” or “Customer”: A person or entity hiring or using a vehicle listed on Rydeo.

  • Vehicle”: Any registered and insured car, truck, or other road-legal vehicle listed on Rydeo.

  • Platform”: The Rydeo mobile app, website, and related services provided by DEFT Mechatronics Pty Ltd.

  • Rental Agreement”: The agreement formed directly between the Owner and the Renter for the use of a Vehicle.

2. Role of Rydeo

  1. Rydeo is a technology platform that connects Owners and Renters.

  2. Rydeo does not own, operate, or control the vehicles listed, nor does it provide transportation services.

  3. Any rental contract is directly between the Owner and the Renter.

  4. Rydeo disclaims liability for disputes, damages, or losses arising out of the rental transaction, except as required under applicable law.

3. Eligibility

  1. Users must be at least 18 years old (or the legal driving/rental age in their jurisdiction).

  2. Renters must hold a valid driver’s licence appropriate for the vehicle class in the jurisdiction of rental.

  3. Owners must be the legal and registered owner of the vehicle, with authority to rent it out.

4. Owner Responsibilities

By listing a vehicle, the Owner agrees to: a. Ensure the vehicle is registered, roadworthy, and legally in the Owner’s name. b. Maintain comprehensive insurance covering rental use, where legally required. c. Keep the vehicle’s service and maintenance history up to date. d. Verify that the Renter holds a valid driver’s licence before handing over the vehicle and retain an electronic copy if permitted by law. e. Deliver and collect the vehicle at the agreed location, time, and condition. f. Disclose any limitations, restrictions, or special conditions of use in the listing.

5. Renter Responsibilities

By booking a vehicle, the Renter agrees to: a. Hold a valid driver’s licence suitable for the vehicle and jurisdiction. b. Present a copy of their driver’s licence to the Owner for sighting (and consent to e-copy retention if legally permissible). c. Use the vehicle in compliance with all traffic laws, insurance requirements, and Owner’s conditions. d. Return the vehicle at the agreed time, date, and location in the same condition as received (reasonable wear and tear excepted). e. Reimburse the Owner for fuel, tolls, fines, excess mileage, cleaning, and any other agreed charges. f. Immediately report accidents, damages, or theft to the Owner and, where applicable, local authorities.

6. Insurance & Liability

  1. The Owner is responsible for ensuring the vehicle is comprehensively insured.

  2. Renters are liable for:

    • Insurance excess or deductible charges in case of an accident;

    • Costs not covered by insurance (e.g., reckless driving, DUI, unauthorised drivers).

  3. Rydeo does not provide insurance cover unless expressly stated.

  4. Owners and Renters are strongly advised to review insurance coverage before entering a transaction.

7. Booking, Payment & Fees

  1. Bookings are confirmed only through the Rydeo platform.

  2. Renters agree to pay all rental charges, deposits, and service fees as displayed at the time of booking.

  3. Rydeo may act as a limited payment collection agent on behalf of the Owner.

  4. Refunds, cancellations, and no-shows are subject to Rydeo’s Cancellation Policy.

8. Prohibited Uses

The Renter may not: a. Use the vehicle for illegal activities, racing, towing, or carrying hazardous goods. b. Permit unlicensed or unauthorised drivers to operate the vehicle. c. Sublease or re-rent the vehicle. d. Drive outside the permitted geographical boundaries set by the Owner.

9. Dispute Resolution

  1. Owners and Renters should attempt to resolve disputes directly.

  2. Rydeo may, at its sole discretion, assist in dispute resolution but is not obliged to mediate or settle.

  3. Users agree to indemnify Rydeo for any claims arising from their use of the platform or rental transactions.

10. Termination & Suspension

Rydeo reserves the right to suspend or terminate accounts where:

  • False information is provided;

  • There is evidence of fraud, illegal conduct, or breach of these Terms;

  • Local legal requirements are not met.

11. Privacy & Data Protection

  1. Rydeo collects and processes personal data in accordance with its Privacy Policy.

  2. Owners may only retain copies of Renter licences and documents where legally permitted and must protect them from misuse.

12. International Use

  1. These Terms are intended for global application. Local laws, regulations, and insurance requirements take precedence in each jurisdiction.

  2. Users are responsible for ensuring compliance with laws in their country of residence or operation.

  3. Where provisions of these Terms conflict with mandatory local law, the local law shall apply to the extent of the conflict.

13. Limitation of Liability

To the fullest extent permitted by law:

  • Rydeo shall not be liable for loss, damage, or injury arising out of or connected to the rental transaction.

  • Users agree that their sole remedy is against the other party to the rental (Owner or Renter).

14. Amendments

Rydeo may update these Terms at any time. Continued use of the platform after updates constitutes acceptance of the revised Terms.

15. Governing Law

  1. These Terms are governed by the laws of the jurisdiction in which DEFT Mechatronics Pty Ltd is incorporated (Australia).

  2. For international transactions, mandatory local consumer protection and rental laws also apply.
